Trademark law protects the owner of a "brand" that is used to "sell" goods or services. This is the key to trademark law: the owner of a mark is the first to use it for particular goods or services. Before you adopt a mark (logo or "name" of a business) be sure that you are the first to use it. You can simply search and see. Ask the question, is there someone that is already using my intended "brand" to identify a different good or service? Does that service operate in the same category as my good or service?
